Terms of Service
Effective date: 3 August 2026
These terms govern your use of Top of Class (“the app”, “we”, “our”), an iOS spaced-repetition study app with AI-assisted flashcard creation. By installing or using Top of Class you agree to these terms. If you don’t agree, please don’t use the app.
1. Who you’re dealing with

2. Your account
Top of Class requires an account for its normal app flow. Authentication is provided through Clerk using the sign-in methods shown in the app, which may include Sign in with Apple. You’re responsible for keeping your sign-in account secure. You must be at least 13 years old (or 16 in some EU countries) to create an account.
3. Your content
Anything you create or import in Top of Class — decks, cards, notes, review history, and any Anki deck you bring in — is yours. You keep full ownership and all rights to your library.
The app is local-first: your library lives on your device. If you enable sync, an account-linked copy is uploaded to our backend so it can follow you across devices and support personalized scheduling. You grant us the limited permission needed to host, transmit, process, and reproduce that content solely to provide those features. You’re responsible for the content you put into the app. Don’t use Top of Class to store or generate content you don’t have the right to use, or content that’s illegal, harassing, or infringes someone else’s rights.
4. The AI feature
Top of Class can generate and rewrite flashcards from material you provide, using a third-party large-language-model provider (see our Privacy Policy for how the material is handled). AI output can be wrong, incomplete, or misleading. You are responsible for reviewing generated cards before you rely on them, especially for exams, professional, medical, legal, or financial subjects. We don’t warrant the accuracy of AI-generated content.
5. License to use Top of Class
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Top of Class on Apple devices you own or control, for personal study, subject to these terms and the Apple App Store’s standard Licensed Application End User License Agreement.
You may not:
- Reverse-engineer, decompile, or disassemble Top of Class except where the law expressly allows it
- Resell, redistribute, or sublicense Top of Class
- Use Top of Class to build a competing product, or to extract our prompts or assets for use outside the app
- Bypass, disable, or interfere with Scholar feature gates, usage limits, or the AI backend
- Abuse the AI feature — for example, automated or bulk requests to run up usage
6. Free and Scholar features
Top of Class offers a free tier and a paid “Scholar” tier. The free tier includes a monthly limit on AI generations. Scholar unlocks unlimited generation and Atlas’s deeper work, as described in the app.
7. Subscriptions, billing, and refunds
- Scholar is sold as an auto-renewing subscription via the Apple App Store. Prices and options are shown in the app at purchase time.
- Payment is charged to your Apple ID at confirmation of purchase. Subscriptions auto-renew unless turned off at least 24 hours before the end of the current period.
- You manage and cancel your subscription in Settings → [your name] → Subscriptions on your Apple device. We can’t cancel it for you because Apple holds the billing relationship.
- Refunds are handled by Apple. Request one at reportaproblem.apple.com.
- If we materially change pricing or what’s included in Scholar, we’ll notify you in the app before the change applies to your subscription.
8. Acceptable use
Don’t use Top of Class to:
- Create content that’s illegal, harassing, defamatory, or sexually exploits minors
- Infringe on intellectual property rights you don’t hold
- Attempt to attack our backend, our sub-processors’ systems, or the AI provider
We reserve the right to suspend or terminate accounts that use Top of Class in violation of these terms or applicable law.
9. Privacy
Our Privacy Policy explains what we collect and how we handle it, including how the AI feature processes the material you submit. By using Top of Class you agree to that policy.
10. Service availability and changes
We do our best to keep Top of Class working, but we don’t promise uninterrupted availability — the AI feature in particular depends on third-party providers. We may add, change, or remove features over time. If we shut down a feature you’ve paid for as part of Scholar, we’ll give you a fair refund or credit through Apple.
11. Disclaimers
Top of Class is provided “as is” and “as available”, without warranties of any kind, express or implied, to the maximum extent the law allows. We don’t warrant that the app will be error-free, that AI-generated cards will be accurate, or that the app will meet your specific study needs.
You’re responsible for keeping backups of any library that matters to you. Top of Class includes an export feature — we recommend exporting a backup periodically.
12. Limitation of liability
To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or lost study material — arising out of or related to your use of Top of Class. Our total liability for any claim is capped at the amount you paid us for Scholar in the 12 months before the claim, or USD 50, whichever is greater.
Some jurisdictions don’t allow these limitations, in which case they apply only to the extent permitted.
13. Termination
You can stop using Top of Class at any time by uninstalling it. To delete your account, see section 9 of the Privacy Policy. We may suspend or terminate your access for material breaches of these terms; in that case, you can still access the library on your device and request a refund through Apple if eligible.
14. Governing law and disputes
These terms are governed by the laws of Sweden, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of Sweden, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings in your local courts — in which case those rights are preserved.
15. Apple-specific terms
Top of Class is licensed, not sold, to you for use only under the App Store Licensed Application End User License Agreement. Apple is not responsible for Top of Class or its content; Apple has no obligation to provide maintenance or support for it. Apple is a third-party beneficiary of these terms and may enforce them against you.
16. Changes to these terms
We may update these terms as the app evolves. The “Effective date” at the top will change. For material changes, we’ll notify you in the app before the change takes effect. Continued use of Top of Class after changes means you accept the updated terms.
